How To Apply For a Forced/Alternative Vehicle Transfer Through Ecitizen

A forced or alternative transfer is a type of vehicle transfer used when the owner cannot be located to facilitate the transfer to a buyer. In Kenya, a forced transfer can occur under the following circumstances:

  • Court order auctions
  • Bank repossession auctions
  • Succession cases
  • Dispute transfers (court orders)
  • Police or uncollected property auctions
  • Distress for rent auctions
  • Diplomat to embassy transfers
  • Situations where the seller cannot be traced

In 2024, the NTSA introduced a new process allowing citizens (buyers) to apply for an alternative transfer through their online portal. The procedure involves the following steps:

  1. Submit an online application for the forced transfer and inspection through eCitizen.
  2. Wait for a 7-day standstill period during which NTSA verifies the process.
  3. Book an appointment and present the vehicle for inspection.

Forced Transfer for a Vehicle Acquired Through a Bank Repossession Auction

To acquire a vehicle through a bank repossession auction, you will need the following documents:

  • Certified copy of a valid auctioneer license
  • Auctioneer registration certificate and KRA PIN for auctioned vehicles
  • Tender documents for the tendered motor vehicle
  • Letter of instruction issued by the financial institution appointing the auctioneer
  • Certificate of sale
  • Original purchase receipt
  • Discharge letter from the bank
  • Official letter requesting the transfer
  • Original registration certificate
  • Certificates of Incorporation for both the bank and the auctioneer
  • KRA PIN for both the auctioneer and the bank
  • Letter from the bank indicating the highest bidder
  • Sworn affidavit by the institution conducting the auction
  • Sworn affidavit by the applicant
  • Tape lift from the DCI
  • Transfer form (Form C)
  • Newspaper advertisement

Forced Transfer for a Vehicle Acquired Through a Rent Distress Auction

To acquire a vehicle through a rent distress auction, you will need the following documents:

  • Request letter from the new owner
  • Original logbook or police abstract
  • Properly filled Form C, stamped by the auctioneer
  • Tape lift from the DCI
  • Sworn affidavit from a magistrate or advocate
  • Copy of ID and KRA PIN for both the current and previous owners
  • Certificate of registration and KRA PIN of the company
  • Copy of the auctioneer’s license and registration certificate
  • Certificate of sale
  • Newspaper advertisement showing the car was advertised for sale through auction
  • Copy of the vesting order
  • Warrant of attachment of movable property
  • Warrant of sale

Forced Transfer For a Vehicle Acquired Through a Police or Uncollected Property Auction

To acquire a vehicle through a police or uncollected property auction, you will need the following documents:

  • Certified copy of a valid auctioneer license
  • Auctioneer registration certificate and KRA PIN
  • Certificate of sale
  • Original purchase receipt
  • Gazette notice and/or newspaper advertisement
  • Sworn affidavit by the applicant
  • Tape lift from the DCI
  • Properly filled and stamped Form C by the auctioneer
  • Copy of the list of vehicles disposed of by the police
  • Official letter requesting the transfer
  • Court order authorizing the auction

Forced Transfer For a Vehicle Acquired a Vehicle Through a Succession Case

To acquire a vehicle through a succession case, you will need the following documents:

  • Certified copy of the Certificate of Grants and the Schedule of Properties
  • Letter appointing administrators of the estate
  • Original registration certificate (logbook) or police abstract
  • Official letter requesting the transfer
  • Certified copy of the death certificate by Civil Registration Services (CRS)
  • Tape lift from the DCI
  • Transfer form (Form C)
  • Sworn affidavit by the successor
  • KRA PIN and ID of the new owner

Forced Transfer For a Vehicle Acquired Through a Court Order (Disputes)

To acquire a vehicle through a court order due to disputes, you will need the following documents:

  • Sworn affidavit by the applicant
  • KRA PIN and ID of the new owner
  • Tape lift from the DCI
  • Transfer form (Form C)
  • Official letter requesting the transfer
  • Court order
  • Original logbook

Forced Transfer For a Vehicle Acquired and the Vehicle Owner Cannot Be Traced

To acquire a vehicle when the owner cannot be traced, you will need the following documents:

  • Copy of ID or Certificate of Incorporation of the registered owner and new owner
  • Sworn affidavit by the applicant
  • Tape lift from the DCI
  • Seller agreement with signed Form C duly filled by the registered owner
  • Official letter requesting the transfer
  • Original logbook or police abstract
  • KRA PIN certificate of both the registered and new owner
  • Court order

Diplomat to Embassy Transfer

To acquire a vehicle through a diplomat to embassy transfer, you will need the following documents:

  • Request letter written by the Embassy or Mission
  • Form A approved by the Ministry of Foreign Affairs
  • Form C approved by the Ministry of Foreign Affairs
  • Customs entry and duty payment receipt
  • Tape lift from the DCI
  • Diplomatic ID for both buyer and seller
  • KRA PIN for both buyer and seller
  • Pro 1 B Form
  • Pro 1 C Form
  • Organisation or Embassy PIN
  • Original logbook

The Procedure For Application For Forced Transfer in Ecitizen

If you have all the required documents for any circumstance mentioned above, follow these steps to apply for an alternative or forced transfer:

  1. Log in to eCitizen: Access your account and select the NTSA Service Portal.
  2. Select Transfer Service: Go to Services and choose Alternative/Forced Transfer.
  3. Fill in Information: Complete the required fields and select the type of alternative transfer.
  4. Attach Documents: Upload original, clear, and colored scanned documents combined into a single PDF file.
  5. Specify Collection Details: Indicate the collection center and the ID number of the authorized person to collect the logbook, then click submit.
  6. Make Payments: Pay for the transfer application and inspection services.
  7. Wait for Verification: Allow 7 days for the verification process.
  8. Book Inspection: After 7 days, log in to your account, view the inspection booking prompt under notifications, and select the preferred center and date.
  9. Present Vehicle: Bring the vehicle for inspection on the scheduled date.
  10. Submit Original Documents: Present the original documents at the identified logbook collection center.
  11. Receive Approval Notification: Once the transfer is approved, you will be notified.
